Terms of Service

1. Acceptance of Terms

By accessing or using GleamPost (“the Service”), operated by GleamPost (“we,” “our,” or “us”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.

These Terms apply to all visitors, users, and paying subscribers of gleampost.com and app.gleampost.com.

2. Description of Service

GleamPost is a software-as-a-service (SaaS) platform that helps businesses turn customer reviews into branded social media graphics. The Service includes:

• Importing reviews from third-party platforms (Google, Yelp, TripAdvisor)
• Creating styled social media graphics from review content
• Publishing content to connected social media accounts
• Managing saved posts, templates, and brand settings

3. Account Registration

To use the Service, you must:

• Be at least 16 years of age
• Provide accurate, current, and complete registration information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account

You must notify us immediately of any unauthorized use of your account. We are not liable for losses arising from unauthorized access to your account.

4. Subscriptions and Billing

Free Trial

New users receive a 14-day free trial with access to all features. No credit card is required to start a trial. At the end of the trial, you may choose a paid plan or continue on the limited free tier.

Paid Plans

Paid subscriptions are billed monthly or annually through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

Price Changes

We may change subscription prices with at least 30 days' notice. Price changes take effect at the start of your next billing cycle after the notice period.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Create or distribute misleading, defamatory, or fraudulent content
• Fabricate or alter customer reviews
• Infringe on intellectual property rights of others
• Attempt to access accounts or data belonging to other users
• Reverse-engineer, decompile, or disassemble any part of the Service
• Use automated scripts to access the Service beyond normal API usage
• Distribute spam or unsolicited content through connected platforms

We reserve the right to suspend or terminate accounts that violate these terms.

6. Content and Intellectual Property

Your Content

You retain ownership of all content you upload to the Service, including logos, images, and brand assets. You grant us a limited license to use this content solely to provide the Service (e.g., rendering your logo on generated graphics).

Generated Content

Social media graphics generated through the Service are owned by you. You are free to use, modify, and distribute them without restriction.

Review Content

Customer reviews imported into the Service remain the property of the original reviewer and/or the review platform. You are responsible for ensuring your use of review content complies with the terms of the originating platform.

Our Intellectual Property

The Service, including its design, code, templates, and branding, is owned by GleamPost and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

7. Third-Party Integrations

The Service connects to third-party platforms including Google, Yelp, TripAdvisor, Meta (Instagram/Facebook), Stripe, and others. Your use of these integrations is also subject to the terms and policies of those platforms.

We are not responsible for the availability, accuracy, or policies of third-party services. Changes to third-party APIs may affect Service functionality.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or modifications that temporarily affect availability. We will provide reasonable notice for planned downtime when possible.

9. Limitation of Liability

To the maximum extent permitted by law, GleamPost shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will meet your requirements, be error-free, or that generated content will achieve any particular results on social media platforms.

11. Indemnification

You agree to indemnify and hold harmless GleamPost and its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately. Data retention after termination is governed by our Privacy Policy.

13. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated by email or through the Service at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.
